Please read the terms of this Terms of Use carefully before accessing the image database. KBL Ltd - The Beauty & Health Company, hereinafter KBL, grants you a right to use solely for use under the following conditions. The image database may be used only if you have agreed to contract terms.
- 1 Use Law
(1) KBL grants the USER a royalty-free non-exclusive and non transferable right of use over the retrieved images.
(2) The use of restricted access image files is granted KBL customers who have received a special access password, "KBL" solely for business use as part of the application of the product lines and "mon amie". The commercial use includes any use that is expected in the ordinary course of business operating normally. Any other use of the images is prohibited.
Violators will be prosecuted, instituted legal action.
(3) The image files are also intended for use in the context of public relations. A publication in this context is explicitly allowed. Each publication is provided with a reference to the legal ownership of KBL. Other publications, eg in other databases or image catalogs, may be made only after prior express written consent of CRL. A transfer of image files to third parties, in particular, by sale, is prohibited. A modification of the image files is permitted under any circumstances without consultation.
(4) Regardless of all the above regulations are text information about image content (IPTC data) and all other published references to the image files by all users to be binding. This is especially true for time limits of the granted usage rights.
- 2 Intellectual property rights / copyright
(1) The USER acknowledges him no further than § 1 beyond rights are granted and undertakes not to infringe the rights of KBL to the image files from any act or omission or to endanger. The USER will make the call for image files, or permit any action that lead to that the rights of third parties to the image files
(2) collection third party claims against the USERS and relate this to the fact that violates the retrieval of image files existing intellectual property rights, will defend against KBL these claims at its own expense, unless the USER KBL notified promptly in writing of the assertion of such claims, his power of attorney to self-management and resolution of the dispute, and granted, if it calls KBL, KBL in an appropriate manner in the conduct of the dispute, including through the immediate provision of judicial and extrajudicial correspondence supported. KBL also have all the necessary information and documents are always immediately available.
- 3 Data protection
(1) The user is advised that to be saved by him as part of the download data transmitted in accordance with the statutory data protection provisions to the extent necessary for contract execution.
- 4 Final Provisions
(1) Subject to German law, excluding conflicts of law and the CISG.
(2) Insofar as the USER is a merchant, our headquarters is the place of jurisdiction.
(3) Of the different terms of use agreements must be in writing. This also applies to the written form requirement itself
(4) If individual provisions entirely or partially invalid, the remaining provisions hereof shall not be affected.
